Welcome to AHA Music. These Terms of Service ("Terms") govern your access to and use of the AHA Music website at aha-music.com, our browser extensions, and all related tools and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Acceptance of Terms
By using AHA Music — whether as a guest, a free registered member, or a paid Pro subscriber — you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of the Service
AHA Music is an online music recognition service. It lets you identify songs by recording ambient audio, humming or singing a melody, uploading audio and video files, or submitting a media URL. We also provide additional tools such as BPM and key detection and an AI music detector. Music recognition is powered by third-party recognition technology provided by ACRCloud. The Service is provided for personal, non-commercial use unless otherwise agreed in writing.
3. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. If you are under the age of 18, you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the Service you represent and warrant that you meet these requirements.
4. Accounts and Registration
You may use certain features of the Service as a guest without an account. To access higher usage limits, recognition history, playlists, and Pro features, you must create an account. You agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity that occurs under your account. We may suspend or terminate accounts that violate these Terms.
5. Plans, Usage Limits, and Advertising
The Service is offered through several tiers:
- Guest — limited free recognitions per day, supported by advertising, with no recognition history or playlists.
- Free Member — higher daily recognition limits, BPM and AI detection, a 30-day recognition history, and a limited number of playlists. Some free recognitions may require watching a short advertisement.
- Pro — a paid subscription that removes advertising and provides substantially higher monthly recognition limits, permanent recognition history, unlimited playlists, and other premium benefits as described on our Pricing page.
Usage limits, feature sets, and prices are described on the Pricing page and may change over time. Free and guest tiers are supported by third-party advertising; by using these tiers you consent to the display of advertisements.
6. Aha Coins
Aha Coins are a free, promotional virtual currency that can be earned through actions such as daily logins, sharing results, inviting friends, or watching ads, and may be spent on additional recognitions. Aha Coins have no monetary value, cannot be purchased, cannot be exchanged for cash, and are non-transferable. We may modify, expire, or discontinue Aha Coins at any time without liability.
7. Subscriptions, Billing, and Auto-Renewal
Pro is offered as a recurring subscription billed monthly or annually at the price shown on the Pricing page at the time of purchase (for example, $4.99 per month or $39.99 per year). Payments are processed by our third-party payment processor, Stripe; we do not store your full card details. By subscribing you authorize us and Stripe to charge your payment method on a recurring basis.
Your subscription automatically renews at the end of each billing period (monthly or yearly) at the then-current price, unless you cancel before the renewal date. Applicable taxes may be added. If a payment fails, we may suspend or downgrade your Pro access until payment is successfully completed.
8. No Refunds
All payments are final and non-refundable. Because the Service delivers digital benefits immediately upon purchase, we do not provide refunds or credits for any subscription fees already paid, including for partial billing periods, unused recognition quota, accidental purchases, or periods during which you did not use the Service. This applies to both monthly and annual plans, to the full extent permitted by applicable law. Where mandatory consumer protection laws in your jurisdiction grant a non-waivable refund right, those rights remain unaffected.
9. Cancellation
You may cancel your Pro subscription at any time from your Account Settings. Cancellation stops future renewals; your Pro benefits remain active until the end of the billing period you have already paid for, after which your account reverts to the Free tier. As stated in Section 8, no refund is issued for the remainder of the current billing period.
10. User Content and Uploads
You retain ownership of any audio or video files you upload or record for recognition ("User Content"). You grant us and our recognition provider a limited license to process your User Content solely for the purpose of providing the recognition results to you. You represent that you have the necessary rights to submit your User Content and that doing so does not violate any law or third-party right. Uploaded audio is processed transiently for recognition and is not retained as a permanent library; see our Privacy Policy for details.
11. Acceptable Use
You agree not to:
- use the Service for any unlawful purpose or in violation of any applicable law;
- attempt to circumvent usage limits, rate limits, advertising, or paywalls, including through automated scripts, bots, or scraping;
- resell, redistribute, or commercially exploit the Service or its recognition results without our written permission;
- interfere with, overload, or disrupt the Service or its infrastructure;
- reverse engineer, decompile, or attempt to extract source code or underlying recognition technology;
- upload content that is unlawful, infringing, or that you do not have the right to submit.
We may impose or adjust rate limits and may suspend or terminate access for suspected abuse.
12. Intellectual Property
The Service, including its design, text, graphics, logos, and software, is owned by AHA Music or its licensors and is protected by intellectual property laws. Song metadata, cover art, and streaming links are provided by third parties and remain the property of their respective owners. Nothing in these Terms grants you any right to use our trademarks without prior written consent.
13. Third-Party Services
The Service relies on and links to third-party services, including ACRCloud (music, humming, and AI recognition), Stripe (payment processing), Google services, advertising providers, and streaming platforms such as Spotify, Apple Music, YouTube, and Deezer. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
14. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that recognition results will be accurate, complete, or available without interruption. Music recognition is probabilistic and may return incorrect results or no result. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
15. Limitation of Liability
To the maximum extent permitted by law, AHA Music and its operators, affiliates, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim relating to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or USD 50, whichever is greater.
16. Indemnification
You agree to indemnify and hold harmless AHA Music and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms or any applicable law or third-party right.
17. Modifications to the Service and Terms
We may modify, suspend, or discontinue any part of the Service at any time, including usage limits, features, and prices. We may also update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
18. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination — including payment obligations, the no-refund policy, disclaimers, limitation of liability, and indemnification — will survive.
19. Governing Law
These Terms are governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of the operator's place of business, except where mandatory consumer law provides otherwise.
